Warerise operates its online store at warerise.com, including all related content, features, tools, products, and services (collectively, the "Services"). Warerise uses Shopify and other third-party service providers to support certain aspects of the Services.
By accessing, browsing, creating an account, or placing an order through the Services, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy, each of which is incorporated into these Terms by reference.

We make reasonable efforts to ensure that product descriptions, images, specifications, pricing, availability, and other information displayed through the Services are accurate and current.
However, we do not guarantee that all information will always be complete, accurate, current, or error-free.
Product images and colors may appear differently depending on your device, screen, browser, or display settings.
All products are subject to availability.
Warerise reserves the right to:
Limit quantities;
Discontinue products;
Restrict sales to certain geographic locations;
Limit purchases by customer, household, account, or order; and
Refuse or cancel orders for lawful reasons.
Product specifications, packaging, labeling, images, ingredients, dimensions, colors, and other product information may change from time to time.
The product shipped may occasionally have packaging or labeling that differs from an image displayed on the website while remaining the same or substantially equivalent product.
Certain products may be subject to federal, state, or local laws, regulations, shipping restrictions, manufacturer restrictions, or geographic sales restrictions.
Warerise reserves the right to restrict or refuse the sale or shipment of products where required or permitted by law.
Certain product information, including descriptions, specifications, images, ingredients, dimensions, and other details, may be provided by manufacturers, distributors, suppliers, licensors, or other third parties.
Warerise does not guarantee that third-party-provided information will always be complete, current, or error-free.
Nothing in these Terms is intended to limit any rights or remedies that cannot lawfully be waived under applicable federal, state, or local law.
When you place an order through the Services, you are submitting an offer to purchase the products identified in your order.
An order confirmation acknowledging receipt of your order does not necessarily constitute acceptance of your order.
An order is accepted only when Warerise confirms acceptance or ships the applicable products.
Warerise reserves the right to review, limit, refuse, or cancel any order for lawful reasons, including:
Product availability;
Pricing or listing errors;
Suspected fraud or unauthorized transactions;
Suspected misuse of promotional offers;
Unusually large or unusual orders;
Shipping restrictions;
Payment issues;
Violations of these Terms;
Product or regulatory restrictions; or
Other circumstances permitted by applicable law.
If Warerise cancels an accepted order after payment has been charged, Warerise will issue an appropriate refund to the original payment method, subject to applicable law.
Once an order has been accepted, processed, or shipped, Warerise may be unable to accommodate a cancellation request.
If you wish to cancel an order, contact info@warerise.com as soon as possible.
Prices, discounts, promotions, and product availability may change at any time.
The price applicable to an order is generally the price displayed at the time the order is submitted, subject to correction of obvious pricing or listing errors.
If a product is listed at an incorrect price due to an error, Warerise reserves the right to correct the error and, where permitted by law, cancel or modify the affected order.
If payment has already been charged for an order that is cancelled because of a pricing error, Warerise will issue an appropriate refund.
Applicable sales, use, or other taxes may be added to your order as required by law.
Shipping, handling, and other applicable charges will be disclosed at checkout when applicable.
You agree to provide accurate and complete billing and payment information.
You represent that you are authorized to use the payment method provided for the transaction.
Payments may be processed through Shopify Payments and/or other third-party payment processors.
Warerise does not intentionally store complete payment card numbers on its own systems.
Your use of third-party payment services may also be subject to the applicable provider's terms and policies.
Shipping and delivery dates displayed on the Services are estimates unless expressly stated otherwise.
Delivery times may vary based on the carrier, destination, weather, holidays, and other circumstances.
Warerise will ship orders within the shipping timeframe stated on the applicable product page, checkout page, or order confirmation.
If no shipping timeframe is stated, Warerise will ship the order within thirty (30) days after receipt of a properly completed order, subject to applicable law.
If Warerise is unable to ship within the applicable timeframe, Warerise will provide any options required by applicable law.
You are responsible for providing an accurate and complete shipping address.
Warerise is not responsible for delivery problems caused by an incorrect, incomplete, or outdated address provided by the customer.
If a shipment is reported as lost, stolen, delayed, or otherwise not received, please contact info@warerise.com promptly.
Warerise may work with the applicable carrier to investigate the shipment and determine an appropriate resolution.
If a package arrives visibly damaged, customers should contact Warerise as soon as reasonably possible and, where available, provide photographs of the package and product.
Nothing in this Section limits rights or remedies that cannot legally be limited.
Warerise primarily ships to addresses within the United States unless otherwise stated at checkout.
If international shipping is offered, customs duties, import taxes, brokerage fees, and other applicable charges may apply and may be the customer's responsibility unless otherwise stated at checkout.
All returns, refunds, exchanges, and related procedures are governed by the Warerise Refund Policy, which is incorporated into these Terms by reference.
Unused and unopened items in their original packaging may be returned within thirty (30) days of delivery, subject to the exclusions and conditions in the Refund Policy.
The following items are generally not eligible for return:
Grocery and food products;
Pet food;
Hazardous materials (Hazmat);
Pillows;
Products with expiration dates;
Products containing or powered by engines, including generators and power equipment;
Outdoor equipment, tools, and furniture;
Heaters and cooling supplies;
BBQ grills;
Oversized items weighing 50 lbs. or more;
Special-order products;
Commercial orders;
Vendor-negotiated or specially discounted orders; and
LTL (Less-Than-Truckload) shipments.
For eligible returns, the refund amount may be determined based on the condition of the item when received by Warerise:
100% refund — Item is unopened, unused, and returned in its original condition and packaging.
50% refund — Item shows signs of use, damage, or other condition issues.
35% refund — Item has been opened and the original packaging or box is damaged.
Original shipping and handling charges are non-refundable unless otherwise required by applicable law.
Warerise reserves the right to inspect returned merchandise before determining the applicable refund amount.
If you receive an item that is damaged, defective, or different from the item you ordered, you must contact Warerise within five (5) days of delivery.
Verified damaged, defective, or incorrect items are handled separately from standard returns and may qualify for a replacement or full refund without a restocking fee, subject to applicable law.
Warerise may request photographs or other information reasonably necessary to evaluate the claim.
Unless otherwise required by applicable law or agreed by Warerise, customers are responsible for return shipping costs for standard returns.
For verified damaged, defective, or incorrect items, Warerise may provide return-shipping instructions or cover applicable return shipping costs.
Approved refunds will generally be issued to the original payment method.
The time required for a refund to appear in your account may depend on your payment provider or financial institution.
The Services, including the Warerise name, logo, website design, original text, graphics, and other content created by Warerise, are owned by Warerise LLC or its licensors and are protected by applicable intellectual property laws.
The Services may display or offer products manufactured, distributed, or branded by third parties.
All trademarks, trade names, logos, product names, product images, packaging, and other intellectual property associated with third-party products belong to their respective owners.
Warerise does not claim ownership of any third-party trademarks or intellectual property displayed on the Services.
The appearance of a third-party brand, trademark, or product on the Services does not imply that Warerise owns, sponsors, endorses, or is affiliated with that brand unless expressly stated.
Subject to these Terms, Warerise grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for lawful shopping purposes.
You may not reproduce, copy, modify, distribute, publicly display, scrape, sell, or commercially exploit Warerise's website content without prior written permission, except as permitted by applicable law.
"Warerise" and any Warerise logos, names, slogans, or other identifying marks are trademarks or service marks of Warerise LLC or their respective owners.
All third-party trademarks appearing on the Services remain the property of their respective owners.
Nothing in these Terms grants you any right or license to use Warerise or third-party trademarks without the applicable owner's prior written permission.

Warerise does not control all third-party services and is not responsible for the independent acts or omissions of third-party providers, except as required by applicable law.

Warerise does not control or endorse third-party websites and is not responsible for their content, policies, security, products, services, or practices.
You access third-party websites at your own risk.
Warerise uses Shopify to provide certain technology and infrastructure supporting the Services.
Purchases made through warerise.com are transactions between you and Warerise LLC.
Shopify is not the seller of products purchased from Warerise and is not responsible for the products, fulfillment, returns, refunds, or customer service relating to transactions between you and Warerise, except as otherwise required by applicable law.
You may have opportunities to submit reviews, ratings, photographs, comments, suggestions, or other content ("User Content").
You are responsible for User Content that you submit.
You represent that:
You have the necessary rights to submit the content;
The content is accurate to the best of your knowledge;
The content does not violate applicable law; and
The content does not infringe the rights of another person or entity.
By submitting User Content, you grant Warerise a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, modify, and publish that content for purposes related to operating, improving, marketing, and promoting the Services, subject to applicable law.
Warerise does not knowingly compensate customers in exchange for positive reviews.
We may remove User Content that violates these Terms, applicable law, or the rights of others.
The Services may occasionally contain typographical errors, inaccurate information, or omissions concerning product descriptions, pricing, availability, promotions, shipping charges, or other information.
Warerise reserves the right to correct errors and update information at any time.
If an error materially affects an order, Warerise may cancel or modify the affected order as permitted by law.
If an order is cancelled after payment has been charged, Warerise will issue an appropriate refund.
By using the Services, you consent to receive electronic communications from Warerise regarding your orders, account, transactions, customer service matters, and other information related to the Services.
You agree that electronic communications satisfy legal requirements that communications be provided in writing, to the extent permitted by law.
If you subscribe to marketing emails, you may unsubscribe at any time by using the unsubscribe link included in the applicable communication or by contacting info@warerise.com.
Transactional communications relating to purchases may continue after you unsubscribe from marketing communications.
If you separately opt in to receive SMS communications, your use of the SMS service may be subject to additional terms and disclosures.
Consent to receive marketing SMS messages is not a condition of purchasing products from Warerise.
You may opt out of marketing text messages by following the instructions provided in the applicable SMS communication.
You may use the Services only for lawful purposes.
You may not use the Services:
To violate any applicable law or regulation;
To infringe intellectual property or other rights;
To commit fraud or engage in deceptive activity;
To impersonate another person or entity;
To interfere with the operation or security of the Services;
To upload malicious software, viruses, or harmful code;

Warerise may suspend or terminate access to the Services where permitted by law if these Terms have been violated.
You may not use automated systems, bots, scrapers, crawlers, or similar technologies to access or collect information from the Services in a manner that:
Interferes with the operation of the Services;
Creates excessive or unreasonable server load;
Bypasses security measures;
Circumvents technical restrictions;
Collects personal information without authorization; or
Violates applicable law.
This Section does not prohibit ordinary search engine indexing or other automated access expressly permitted by Warerise.
Warerise may use technical measures to limit or block unauthorized automated access.
Warerise may suspend or terminate your access to the Services where permitted by law, including if you violate these Terms or engage in fraudulent, abusive, unlawful, or harmful conduct.
Termination does not affect obligations or rights that accrued before termination or provisions that by their nature should survive termination.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
EXCEPT AS EXPRESSLY PROVIDED BY WARERISE, WE DISCLAIM WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE DO NOT WARRANT THAT PRODUCT INFORMATION, CONTENT, PRICING, AVAILABILITY, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICES WILL ALWAYS BE COMPLETE, CURRENT, OR ERROR-FREE.
NOTHING IN THIS SECTION DISCLAIMS OR LIMITS ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED OR LIMITED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WARERISE LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, WARERISE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR A PRODUCT PURCHASE WILL NOT EXCEED THE GREATER OF:
The amount you paid to Warerise for the product or order giving rise to the claim; or
One hundred U.S. dollars ($100).
These limitations do not apply to liability that cannot legally be limited or excluded, including liability for fraud or fraudulent misrepresentation or death or personal injury caused by negligence where applicable law prohibits such limitation.
Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, some of the above limitations may not apply to you.
To the fullest extent permitted by law, you agree to indemnify and hold harmless Warerise LLC, its affiliates, officers, directors, employees, agents, contractors, service providers, and licensors from third-party claims, damages, liabilities, losses, and reasonable expenses arising from:
Your violation of these Terms;
Your violation of applicable law;
Your violation of the rights of another person or entity; or
Your misuse of the Services.
This Section does not require you to indemnify Warerise for claims caused by Warerise's own conduct to the extent such indemnification would be prohibited by applicable law.
Warerise will not be responsible for delay or failure to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, labor disputes, government action, carrier failures, supplier failures, power outages, telecommunications failures, internet disruptions, cyberattacks, or other events beyond our reasonable control.
This Section does not eliminate any rights or obligations that cannot legally be excluded.

To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Bergen County, New Jersey.
You and Warerise consent to the personal jurisdiction and venue of such courts, subject to any rights or requirements provided by applicable law.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Your use of the Services is also governed by our Privacy Policy.
Information collected through the Services may be processed by Warerise, Shopify, payment processors, shipping providers, analytics providers, advertising providers, and other service providers as described in our Privacy Policy.
Please review our Privacy Policy for information regarding the collection, use, disclosure, retention, and protection of personal information and any applicable privacy rights.
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
These Terms, together with the policies expressly incorporated by reference, constitute the entire agreement between you and Warerise concerning your use of the Services and supersede prior or contemporaneous agreements concerning the same subject matter.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where prohibited by applicable law.
Warerise may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate reorganization, sale of assets, or similar transaction.
Section headings are provided for convenience only and do not affect the interpretation of these Terms.
Warerise may update or modify these Terms from time to time.
The current version will be posted on this page with an updated "Last Updated" date.
If we make material changes, we may provide additional notice where required by applicable law.
Changes will not retroactively modify orders that were already accepted unless required or permitted by law.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
